...HOMEWORK 2 Avoiding Permanent Damage from Temporary Help Dated: 08/01/2012 Keller Graduate School of New York Course MGMT 520 Business: Its Legal, Ethical, and Global Environment In nowadays, background check of hiring employee is practicing by almost all agencies. Point is that, the skills of the applicant can be, somehow, figured out. It is much more difficult to assess the level of trust, honesty, mental toughness, and loyalty. Reading through chapter 9, and conducting a slight research, my answers to the questions of the given scenario are as follows: 1. Do temporary agencies have a “duty” to run background checks? If so, did Robert half “breach that duty?” Why or Why not? According to the law of negligence, temporary agencies should follow the duty policy on background check on pre-employment, in order not to satisfy an element of negligence. In case of Robert Half International Inc., and Fox Associates, Inc., I don’t think, that duty was breached, the company trusted to provided information by Ms. Ross about herself, and she got good recommendations from her former employers. At some extend, it is a background check. 2. The court ruled against Fox Associates. Was the court correct? Do you think Fox should have done its own background check? Why or Why not? I agree with the court decision, that it was determined that duty is not breached, because it happened unknowingly. Even though the company recommended the employee, Fox could do its own......

E-Business Homework # 1

...3rd, 2012 Homework 1 1. How does e-Business differ from e-Commerce? Give a definition for e-Commerce and examples to explain the differences. E-Business is the conduct of transactions by means of electronic communications networks (e.g., via the Internet and/or possibly private networks) end-to-end. E-Commerce is a part of e-Business, which has to do with the buying and selling of goods and services, and the transfer of funds through digital communications. E-Business is different from e-Commerce because it deals with digital transactions and processes within a firm, involving information systems under the firm’s control. E-Business does not just refer to information exchanges related to buying and selling, but it also has to do with servicing customers and collaborating with business partners, distributors and suppliers. Another way e-Business is different from e-Commerce is that e-Business encompasses sophisticated business-to-business interactions and collaboration activities at a level of enterprise applications and business processes. E-Commerce is different from e-Business because it mainly deals with just the buying and selling, whereas e-Business deals with more than just buying and selling. Also, e-Commerce primarily deals with on-line display of goods and services, ordering, billing, customer service and handling of payments and transaction. One final difference between e-Business and e-Commerce is that e-Business includes key business processes......

Business Law Homework Week 2

...Business Law Week 2 Assignment 14.2 Real Property In the case of Briggs v. Sackett, the Sacketts win the case. The parties entered into an oral collateral contract for Briggs to sell his house to the Sacketts under the conditions that the Sacketts pay the three months’ arrearages on the loan and agree to make future payments on the mortgage. After fifteen years Briggs filed an action to void the oral contract as in violation of the Statute of Frauds. Although the Statute of Frauds requires collateral contracts to be in writing, there is an exception that overrides this requirement. “The main purpose exception is an exception to the Statute of Frauds which states that if the main purpose of a transaction and an oral collateral contract is to provide pecuniary benefit to the guarantor, the collateral contract does not have to be in writing to be enforced.”(Cheeseman 222) The Sacketts indeed provided a pecuniary benefit to the Briggs by helping them catch up on past due payments and keeping the payments current for fifteen years. The main purpose exception overrides the Statute of Frauds and therefore the Sacketts win. 16.10 Intentional Interference with Contractual Relations The case between PG & E v. Bear Stearns is an example of “a tort that arises when a third party induces a contracting party to breach the contract with another party.” (Cheeseman 257) PG & E can sue Bear Stearns based on the basis of the intentional interference with contractual......

...Homework and Testing 1 Homework and Testing Assigning Homework How much is too much? As with classroom assignments, homework should never be given as busy work. It should have a purpose with a goal. And as I mentioned in the Behavioral Approach to Learning, homework should NEVER be given as punishment. The kid will associate homework with punishment. This may interest you. Harris Cooper (1998) analyzed more than 100 research studies on homework in American schools. He found that homework had a very small connection with test scores at the elementary level. If anything, the more homework an elementary school student had, the more negative their attitude was toward school. Plus it takes away from their social time, which is an important part of growing up. Kids need to learn social skills. Too much homework causes stress, as you probably know very well by now. Kids need to have down time too! Why does homework have such a small effect at the elementary level? One reason is that young children have limited attention spans and are very distractible. It is difficult to do homework in a house that has many distractions. Teachers need to work with parents and help students find a quiet space to do homework. Most professional organization in education agrees that homework should never exceed 10 - 20 minutes per day in grades K - 2. In grades 3 - 6 homework should never exceed 30 - 60 minutes per day. Another reason elementary school children do not benefit much from homework is...

During the period Buder and Sartore were going through divorce. Money was given to Buder to safeguard for his kids with the understanding that he would safeguard the money and invest it on behalf of the children. Buder invested money in “blue chip” stock and penny stock on his name as custodian for the children, as required by the Uniform Gifts to Minors Act (UGMA).This stocks suffered a major loss except one Buder’s ex-wife, Sartore, sued him, alleging that he had breached his fiduciary duty owed to the children under the UGMA.
