For the Unit 3 paper, respond to the following hypothetical situation. Identify the intentional torts and available defenses involved, if any, and support your answers.

Hypothetical:
FACTS:
Leroy McPhillen frequented a pub called Bottom's Up! Late one Saturday night, an intoxicated man named John began shouting obscenities at a woman sitting at the table next to Leroy's. The woman, Jane, ignored the man and continued to drink her beer. John approached Jane, looking ominous.

Leroy stood and asked the fellow over to the bar for a drink. John grumbled that Leroy should mind his own business. John reached out and grabbed Jane's wrist and Leroy neatly twisted John's other arm behind his back while restraining him with a neck hold. John protested vehemently, but Leroy did not let go. Leroy placed John firmly into a chair and told him not to move, or else Leroy would have to punch him. That’s when Jane told Leroy that the man was her husband.

QUESTIONS:
Which intentional torts were committed, and what defenses are available to the tortfeasor?

Hypothetical Working Agreement

...Hypothetical Working Agreement Cynthia Boland BSHS 322 December 24, 2012 Tracey Newman Hypothetical Working Agreement This paper is meant to focus on a hypothetical working agreement for one of the specified scenarios from our textbook. The working agreement should have four parts; Assessment, Goal setting, Contacting and Evaluation. This paper will state clearly the key elements and purpose of each of the four parts in the working agreement using this specific case scenario. The case that I chose to use from the text is the case of Thomas, a 20-year-old college sophomore who has dropped out of school. He has just been diagnosed with schizophrenia. His mother has brought him to the day center saying she hopes that “somehow he will be able to get back to college.” Assessment This is the stage when elaboration and exploration skills are used in assisting in assessing the story from the client. “Gathering and analyzing of information about a client is done at this stage in order to tackle the problem” (Murphy, B. C., & Dillon, C. (2011). It is also good for clinicians to do a structured assessment formally and reasonably to fulfill the purpose of diagnosis, plan treatment and carry out research on the best specialized services that are needed by the client. Assessment The purpose of an assessment is to get a vast amount of adequate information about the client. This can include basic information such as name, age, birthdate, address, and telephone number. It......

Hypothetical Paper

...Professor H Part 3. Three Leads into a hypothetical paper 1) As a student, my goal is to reach the apex of success. This is quite a common characteristic in most of my peers. We all someday want to obtain a comforting salary, which is complete “normal”. However, this idea of money being the key objective to the majority of scholars can be looked upon negatively. I understand some people may need money for reasons such as: family problems, debts, etc. However, how many people want the “money, cars, and clothes”? (Common saying among modern rappers). I find this to be somewhat disturbing; think about it. When most young individuals such as athletes, come into large sums of money, it is spent poorly. Poorly is actually an understatement, pathetically is more appropriate. What I am trying to say is, are all intentions revolved around money? In this current generation, it sure seems like it. 2) When common interests being shared are completely evident and visible it creates a welcoming environment. Common characteristics create sports teams, scholastic clubs, and many meeting places. There is special bond that is created through sharing similar characteristics with one another. A strong attraction is prevalent in all areas where people know they share a common interest with others. I am fascinated by the fact that this particular “bond” that is create can practically be seen by the naked eye. It truly is amazing. There is nothing more welcoming than walking into class on...

Leroy Mchphillen

...M. Salas-Pellot PA165-01 – Unit 3 Professor Laurence Mraz Kaplan University February 19, 2013 FACTS: Leroy McPhillen was a regular patron of The Bottom’s Up Pub, an intoxicated man named John, began shouting obscenities at a woman seated at a table near Mr. McPhillen. As the woman ignored the man’s ranting, the man approached the woman in a threatening manner. Before the man reached the woman, Mr. McPhillen invited the man to join him at his table. The man refused and grabbed the woman’s wrist. Mr. McPhillen then carefully twisted the man’s arm behind his back and restrained him with a neck hold. Mr. McPhillen refused the man’s request to release him, and firmly seated the man and threatened to punch him if he moved. The woman then informed Mr. McPhillen that the man was her husband. ISSUE: The questions presented are which intentional torts were committed, and what defenses are available to the tortfeasors? Both John and Leroy are guilty of committing intentional torts. Both parties have debatable defenses. Though the fact remains that more information is needed regarding the events that occurred prior to the assault and battery to the woman, and the time of how long the intoxicated man was confined. Before determining what are the applicable......

...Running head: HYPOTHETICAL WORKING AGREEMENT Hypothetical working agreement Libby McGrath University of Phoenix Communication skills from the Human Services Professional 322 Connie Giles April 29, 2013 Hypothetical working agreement Freydia, a 27 year old mother of two has been addicted to crack for 4 years resulting in her children being removed from her home be child protective services. They are currently living with her mother, and Freydia would like to regain custody of them. Since Freydia, is new to me I have to take the time to get a good assessment of her, does she really want to quit using? Does she really want her children back? How much is she willing to do to get her children back? The assessment is not something I can do just by listening to her, I need to watch closely and pick up on her non verbal gestures. By paying attention to both verbal and non verbal conversations as a clinician I can learn a lot about Freydia and evaluate her and what goals would be easiest for her to obtain at this time. After determining what goals works best for her we are now able to form a contract of sorts to go along with our goals prioritizing which might be more important than the next. After evaluating and assessing Freydia I have decided that making rehab a priority, would be the most important goal for Freydia to set, she would need to be sure to attend every meeting, and if she doesn’t think she can do that, she might have to become a resident in an......

Human Resources Hypothetical

...Hypothetical 1 Casey Hand Human Resource Management Professor John DiCicco September 18, 2013 An organization begins with a set of values that they want the company to possess and these values are emulated through the mission statement of the company, and are also used to create a company vision based on their current strengths, weaknesses, and external demands. In order to achieve the vision there needs to be a strategy in place to recruit a team of proper talent also holding those values the company is passionate about. Author Gary Dessler of, A Framework for Human Resource Management, gave an example of the strategic plan of the Ritz-Carlton Portman Hotel in Shanghai and their goal to “cultivate a service-oriented employees”. They did this by having top management interview each candidate and only hiring the employees who “cared and respected others”. Human resource strategies carried out by the Ritz-Carlton aligned the mission of providing superior service to create the culture desired by the organization. With respect to establishing an organizations culture there are aspects of the human resource managers that help provide employees with job satisfaction and in turn, increase job efficiency. Employees want to feel good about what they do, they want to climb Maslow’s hierarchy of needs pyramid and feel secure. Therefore, providing stability through compensation and benefits package helps employees reach that personal goal. ......

Intentional Torts Od Leroy Mcphillen

...Intentional Torts and Defenses of Leroy McPhillen and John Victoria Downie Kaplan University Professor Randee Breiter Torts and Personal Injury PA165 May 31, 2015 Intentional Torts and Defenses of Leroy McPhillen and John Human and animal nature is defined by the subconscious behavior of the fight or flight instincts. People have the ability to view situations and determine whether they need to fight for their life or run. What sets us apart from animals is that we also have the ability to determine whether other people need us to fight for them when they cannot fight for themselves, as seen in the case of Leroy McPhillen versus John. Leroy McPhillen was a frequent client of Bottom’s Up Pub. One Saturday night Leroy noticed an intoxicated man shouting obscenities at a woman seated at a table within close proximity to Leroy McPhillen’s table. While the woman ignored the man and continued to drink her beverage, Leroy asked the intoxicated man to join him for a beer at the bar. The man mumbled that “Leroy should mind his own business” and proceeded to grab the woman’s wrist. It was at this point that Leroy grabbed the man, later identified as John, by his other arm and neatly twisted behind his back while placing him in a neck hold. John began to protest violently. Leroy then place John in a chair and informed him not to move or he would “have to punch him”. It was at this time the woman, identified as Jane, informed Leroy that the man was in......

...LeRoy Karas LeRoy Karas was once a start athlete with a hidden desire to drink, smoke and party that ultimately affected his grades (Zastow & Kirst-Ashman, 2010). He married his high school sweetheart and had three children, and due to his alcoholism, he became abusive and his wife left him, taking the children with her (Zastow & Kirst-Ashman, 2010). He had another child with an unknown woman and eventually remarried having two more children (Zastow & Kirst-Ashman, 2010). He never gave up his addictions and his second wife left him, and his work relationships faulted as well (Zastow & Kirst-Ashman, 2010). Due to his drinking and smoking, his health took a turn for the worst, and he was diagnosed with cirrhosis and emphysema, and is currently living in a long term care facility (Zastow & Kirst-Ashman, 2010). Based on the ecomap, I would say the strongest influences on his behavior would relate directly to alcohol and smoking. From early on alcohol was present through his educational years and through his failed interpersonal relationships (Zastow & Kirst-Ashman, 2010). His income from his work went on drinking and smoking and he owed child support (Zastow & Kirst- Ashman, 2010). While he was drinking and in his marriages, he would become violent while intoxicated, and later on in life, due to his alcohol addiction and smoking, his health deteriorated (Zastow & Kirst-Ashman, 2010).
