Office of residence life New Resident Two Semester Residence Hall Contract 2014-2015
NOTE: Your $310 Housing Reservation Fee, which includes the Theft, Fire, Natural Disaster and Accidental Damage Insurance Fee, must be submitted with this contract. Your contract will be considered VOID without these fees.The Housing Reservation Fee is nonrefundable. NOTE: Students will not be permitted to check-in to university housing until they have completed all necessary processes to obtain satisfactory status with the university. SECTION I. INTRODUCTION Kentucky State University requires every full-time freshman and sophomore to live in university housing with the following exceptions: 1) students who are veterans of at least two years of active military service, 2) students who commute from the home of parents or a legal guardian, 3) students who are married or 4) students 21 years of age or older. All freshman and sophomore students who register for classes at Kentucky State University and do not meet these exception requirements will be charged for room and board. The university agrees, under the terms of this contract, to provide space in one of its residence halls. The resident agrees to pay the room rate in accordance with the published schedule of fees for the year. (For the current fee schedule, visit www.kysu.edu and click on the Current Students or Prospective Students tab. Under the Finances heading, click on Bursar’s Office and then click on the Fee Schedule tab.) SECTION II. RESIDENCE HALL ELIGIBILITY Only registered, admitted students are eligible for residence hall occupancy, according to university policy. The resident agrees to vacate the residence hall within 72 hours in the event his or her student registration status is revoked at any time during the academic year. SECTION III. CONTRACT AND RESERVATION FEE Each student desiring to reside in university housing will be required to sign a Kentucky State University Two Semester Residence Hall Contract and pay $310. A signed, completed contract and full payment of the Housing Reservation Fee are required for acceptance into university housing. All fees must be paid in the form of certified check, cashier’s check, money order, personal check or major credit card to: Kentucky State University Office of Residence Life 400 East Main Street Academic Services Building, Room 317 Frankfort, KY 40601 ( please do not mail cash) The $310 will apply to: $50 - Housing Access Control Fee $60 - Personal Property Insurance $75 - Room Reservation Fee $125 - Damage Maintenance Fee At the end of your housing occupancy you are eligible for a $50 refund, provided that you do not have any outstanding fees for damages. A Damage Deposit Return Form must be submitted within 90 days after occupancy to receive the refund. The $75 Room Reservation Fee will be credited to the students account. The $60 Personal Property Insurance Fee is required to be purchased every year. HOUSing FeeS are nOn-reFUndaBle. In the event that a prospective resident has completed the housing reservation process by the appropriate deadline and is not granted university housing due to occupancy levels, he or she will be refunded the Housing Reservation Fee. This agreement is for the entire academic year (fall and spring semesters) or for the portion of the academic year remaining at the time. The effective date of this contract is established upon physical check-in to a residence hall and receiving an access card/key for a designated room. The resident agrees that upon physical check-in to a residence hall, he or she will be responsible for all applicable charges for the full term of this contract. If after completing the residence hall contract a student chooses to cancel the application, he or she is required to do so in writing to the Office of Residence Life, 400 East Main Street, ASB Room 317, Frankfort, KY 40601. Cancellations may be done in person, by fax (502-5975896), by email (reslife@kysu.edu) or by mail. Phone cancellations will not be accepted. Cancellation for the spring semester applies only to students who are applying for the first time for the spring semester. It does not apply to students who lived in university housing during the fall semester. The Housing Reservation Fee is non-refundable. The date the cancellation notification is date/time stamped in the Office of Residence Life will be the official date of cancellation. Residents who live in university housing during the fall semester and are not returning to Kentucky State University for the spring semester must complete the checkout process with the hall manager. a resident forfeits his or her assigned room when he or she has not checked in to the residence hall by noon the day after the official Move-in day. Residents who need to check-in to the residence hall after the deadline must submit a written notice (via e-mail at reslife@kysu.edu, letter or fax at 502-597-5896) to the Office of Residence Life before noon the day after the official move-in day. Failure to give notice of checking in may result in reassignment or loss of assignment. Release from the contract for residents during the contractual period will be for the following reasons only: 1) withdrawal from the university, 2) graduation, 3) dismissal from the residence hall or the university or 4) marriage. A request for release from the agreement does not constitute an automatic release. Refunds for release from the Housing Contract are governed by the University Tuition and Fee Refund Policy for each semester. If during the contractual period the resident vacates the residence hall without written authorization from the director of residence life, the resident remains liable for full payment of the contract. The university reserves the right to deem a room in the residence hall as being vacated or abandoned by the resident and to revoke residence hall access. A resident who vacates or abandons a room agrees to remain liable for full payment of charges for the full term of this contract. Students who withdraw from the university are required to notify the Office of Residence Life in writing and complete the checkout process with the hall manager. Students will be assessed charges for room and board based on the university’s refund schedule. SECTION IV. ASSIGNMENT The university reserves the right to make all room and residence hall assignments. The university makes all assignments without regard to race, ethnic origin, sexual orientation, color, creed, religion, age, political belief or national origin and rejects all requests for changes of assignment based upon the protected classifications. The university also reserves the right to change room assignments as necessary. Designations made on the Housing Priority Assignment Form are not guaranteed. Freshman- and sophomore-status students are given priority status in university housing due to the residency requirements of the university. The university reserves the right to determine the gender for all of its residence halls. (ALSO SEE SECTION XII. HOUSING PRIORITY ASSIGNMENT FORM) The university reserves the right to consolidate assignments if a vacancy occurs. The resident agrees to accept another roommate as assigned, or move into another room if requested; or if occupancy permits, students may be able to pay the single cost rate for the current semester. The increased rate would be applied to the student’s account immediately. SECTION V. CLOSINGS The residence halls at Kentucky State University are closed during the Winter Break. All residents agree to vacate the residence halls on or before the official published closing date. Residents agree to not re-enter the residence halls until the halls have officially reopened. SECTION VI. TRANSPORTATION AND PARKING The university does not assume the responsibility of transporting residents. This applies to transporting students to and from bus stations and airports during official academic closings. Parking for residents operating motor vehicles on university property is provided per University Parking Policies and Procedures. Residents agree to abide by these policies and procedures. SECTION VII. BUILDINGS AND ROOMS The resident agrees to be liable and subject to charges for any and all damages to the building, facilities and furnishings incurred by the resident or his/her guests. The resident agrees to pay any and all charges exceeding the Damage/Maintenance Fee. The resident also agrees to pay another Damage/Maintenance Fee according to the fee schedule upon incurring assessed damages. When a room’s furniture layout is changed from its original arrangement, the resident agrees to place all furniture back to its original layout prior to the end of each academic semester’s residence hall closing as scheduled. The resident also agrees to not remove any room furniture without written authorization from the residence hall manager. The resident agrees not to apply any decorations to the furnishings, walls or doors of the building that will damage or deface any of the aforementioned items and areas. The resident also agrees to be liable and pay the charges outlined in this section should decorations applied by the resident cause any damages requiring repair. The resident agrees to keep his or her access card/key in his/her possession at all times. The resident agrees not to loan his or her access card/key to anyone for any reason and understands that doing so may make him/her subject to disciplinary action. The resident agrees to be liable for any misuse of his or her access card/key. The resident also agrees to immediately report a lost or stolen access card/key to the residence hall manager’s office or to the Office of Residence Life. The resident agrees the university reserves the right to have duly authorized personnel enter and inspect a resident’s room without prior notification for the purposes of health, safety and security and for conducting maintenance. SECTION XIII. PERSONAL PROPERTY The resident agrees to secure his or her personal property at all times. The resident agrees that the university accepts no responsibility for any lost, stolen or damaged personal property. The university requires each student to pay $60 annually for a Theft, Fire, natural disaster and accidental damage insurance policy. in the event that personal items are lost, stolen or damaged, the resident will be responsible for filing a claim with the insurance company of record. residents are provided with a Valuable Property inventory Form at the beginning of each semester. This form should be completed by the resident and can serve as official proof of ownership for a resident’s personal property. The Valuable Property inventory Form must be verified and signed by the hall manager at the time of completion. residents are responsible for updating the Valuable Property inventory Form throughout

the year as necessary. The Theft, Fire, natural disaster and accidental damage policy is a personal policy for each resident and insures the named resident’s property for one year from the date of purchase. This insurance is limited to current policy guidelines as indicated by the insurance company of record. The resident agrees to remove his or her personal property at the end of the contractual period or when the resident permanently vacates the residence hall. The resident agrees the university is not liable for personal property remaining in the residence hall during official academic closings as scheduled. The resident agrees that any and all personal property remaining in the residence hall after the end of the contractual period or when the resident permanently vacates the residence hall, as determined by the university, may be removed and disposed of at the discretion of the university any time prior to the beginning of the next contractual period. The resident agrees to hold the university and its board of regents, agents and employees harmless from any suit, action at law or claim whatsoever resulting from or arising out of any injury to the student’s person or property while an occupant of a residence hall, in any recognized programming event sponsored by the residence hall in which the occupant lives, except where such injury is caused by the negligence of the university or its agents. (If the resident is a minor, the covenant contained in this paragraph shall be construed as the covenant of the student and his or her parent or guardian.) SECTION IX. VISITORS The resident accepts full responsibility for the conduct of his or her guests or visitors. The resident agrees that damages incurred by guests or visitors are the responsibility of the resident. The resident agrees to abide by the university policy regarding guests or visitors on university property, including the residence halls. The resident agrees to register any guests or visitors in accordance with residence hall procedures. The resident also agrees not to lend his or her residence hall access card/key to guests or visitors. Only residents assigned to a particular room are permitted to remain in the room after 2 a.m. without having completed a Request for Overnight Visitation. Residents who allow a guest or visitor to stay in the room overnight without approval will be charged with a visitation violation and will be subject to residence hall rule violation sanctions. The university reserves the right to ban any guest or visitor who is not a student at Kentucky State University from its residence halls. SECTION X. EVICTION The resident acknowledges and understands that the university reserves the right to immediately evict a resident for violation of published offenses for which a resident may be evicted. The resident also agrees to comply with sanctioned action or actions for infractions of residence hall rules of conduct. Should a student be evicted from the residence hall during the semester, charges will be assessed as governed by the University Tuition and Fee Refund Policy. Students who are evicted from the residence hall may apply for campus housing for the next semester by completing a New Resident Two Semester Residence Hall Contract and paying the current housing fees. However, the university reserves the right to deny an application. SECTION XI.
